How Subject-To Works — and Why Legal Structure Is Non-Negotiable

A subject-to acquisition means you take title to a property while the seller's existing mortgage stays in place — in the seller's name, with the seller's terms, but with you making the payments. You own the property. The seller is no longer responsible for the day-to-day — but their loan is still on the title until you pay it off, refinance, or sell.
